Delivery and Return Policy

These terms and conditions define the delivery and return policies of SIA Amber Cloud for all purchases made in the online shop www.ekokrasas.lv.

1. DELIVERY

1.1. Delivery Options:

  • Omniva parcel lockers: €2.99
  • SmartPost and Venipak parcel lockers: €1.99
  • Courier delivery: €4.99
  • Delivery to Estonia and Lithuania: €5.99 (2–4 business days)
  • Delivery to Ireland: from €12.00 (5–7 business days)
  • Delivery to Germany: from €5.99 (4–6 business days)
  • Delivery to Austria: from €12.99 (4–6 business days)
  • Delivery to Switzerland: from €14.90 (4–6 business days)
  • Delivery to Netherlands: from €12.90 (4–6 business days)

1.2. Delivery Times:

Orders are usually delivered within 2–4 business days after full payment has been received. Unless otherwise agreed, delivery will take place no later than 30 days after conclusion of the contract. The seller reserves the right to extend delivery times due to unforeseen circumstances, in which case the buyer will be informed promptly.

1.3. Obligations of the Buyer During Delivery:

The buyer must provide an accurate delivery address and correct contact information to ensure successful delivery. Upon receipt of the goods, it is the buyer’s responsibility to visually inspect the packaging. If any damage to the packaging is detected, the buyer has the right to refuse acceptance of the goods and must inform the seller immediately.

1.4. Delivery Delays:

SIA Amber Cloud assumes no responsibility for delays caused by the courier service provider or by circumstances beyond the seller’s control. If delivery is delayed by more than 30 calendar days, the buyer has the right to unilaterally withdraw from the distance contract and to request a refund for services or goods not delivered.

1.5. Undelivered Goods:

If the goods are not accepted at the time of delivery due to reasons attributable to the buyer (e.g., incorrect address provided, no identification document presented, etc.), SIA Amber Cloud reserves the right to claim compensation from the buyer for the costs of re-delivery.

2. RETURNS

2.1. Right of Withdrawal:

In accordance with Latvian consumer protection law and the EU Consumer Rights Directive, the buyer has the right to withdraw from the distance contract within 14 days of receiving the goods, without stating any reason. Within this period, the buyer may exercise their right of withdrawal and return the goods.

2.2. Conditions for Returning Goods:

  • The product must be unused, complete, and in its undamaged original packaging.
  • Cans and packaging must not be opened or damaged; otherwise, the goods cannot be returned.
  • The buyer must complete the return form and obtain a product return authorization number (PAN) before sending the goods back.

2.3. Return Process:

Goods can be returned via Omniva parcel lockers, Latvian Post, or another courier service of the buyer’s choice. The costs for returning goods are borne by the buyer, except in cases where the goods are damaged or do not match the order.

2.4. Refunds:

Once the returned goods have been received and inspected, SIA Amber Cloud will refund the money within 14 days to the bank account provided by the buyer. The refund includes the purchase price of the goods and the standard delivery costs, minus any costs for a more expensive delivery method chosen by the buyer, unless the goods were damaged or did not match the order.

2.5. Exceptions to the Right of Withdrawal:

  • The right of withdrawal does not apply to goods that have been custom-made or customized according to the buyer’s individual specifications.
  • The right of withdrawal cannot be exercised if the product has been damaged due to improper use by the buyer or has lost its original appearance and quality.

2.6. Model Withdrawal Form:

You may use the attached model withdrawal form, although this is not mandatory. Alternatively, you can simply send your withdrawal by email to info@ekokrasas.lv.

3. WARRANTY AND LIABILITY

3.1. Statutory Warranty:

A statutory warranty period of 24 months from delivery of the goods applies to consumers. The warranty does not apply to damage caused by improper storage or use of the paint, or if the original packaging has been opened, insofar as the defect results from this. This provision does not affect the buyer’s rights with respect to defects that already existed at the time of delivery.

3.2. Liability for Damaged or Non-Conforming Goods:

If the buyer receives goods that are damaged, of poor quality, or do not match the order, the buyer has the right to return the goods or request an exchange for new goods.

3.3. Timeframe for Reporting Defects:

The buyer must inform the seller within a reasonable period after discovering the defect by contacting customer support at info@ekokrasas.lv or by calling +371 286 862 84.

3.4. Warranty Service:

Complaints regarding product quality will be handled in accordance with Latvian consumer protection regulations. SIA Amber Cloud does not guarantee the suitability of the products for specific requirements or purposes of the buyer unless expressly stated in the product description.

4. DATA PROTECTION AND PRIVACY

4.1.

The buyer’s personal data is processed in accordance with our privacy policy and the cookie policy available on the website www.ekokrasas.lv. Personal data obtained during the ordering and return process is used solely for fulfilling these processes.

4.2.

Personal data may be shared with third parties (e.g., courier service providers) in order to facilitate delivery or return of goods.

5. DISPUTE RESOLUTION

5.1.

All disputes arising in connection with these delivery and return conditions shall be resolved through mutual negotiations. If no agreement is reached, the dispute shall be settled in accordance with the legal provisions of the Republic of Latvia before the courts of the Republic of Latvia. For consumers, the law of the country in which the consumer has their habitual residence shall apply, insofar as mandatory consumer protection provisions of that country are applicable.
