Delivery and Return Policy

These terms set out the delivery and return conditions of SIA Amber Cloud for all purchases made in the online store www.ekokrasas.lv.

1. DELIVERY

1.1. Delivery options:

  • Omniva and DPD parcel lockers: €2.99
  • Venipak parcel lockers: €1.99
  • Latvijas Pasts: €2.29 
  • Courier delivery: from €5.99 (Latvia)
  • Courier delivery to Estonia and Lithuania: from €10.99 (2–4 business days)
  • Delivery to Omniva parcel locker in Estonia and Lithuania - €4.69 € (2–4 business days)
  • Delivery to Ireland: from €12.00 (5–7 business days)
  • Delivery to Germany: from €5.99 (4–6 business days)
  • Delivery to Austria: from €12.99 (4–6 business days)
  • Delivery to Switzerland: from €14.90 (4–6 business days)
  • Delivery to the Netherlands from €12.90 (4–6 business days)

1.2. Delivery times:

Goods are usually delivered within 2–4 business days after full payment is received. Unless otherwise agreed, delivery will be made no later than 30 days after the conclusion of the contract. The seller reserves the right to extend the delivery period due to unforeseen circumstances, of which the buyer will be informed in a timely manner.

1.3. Buyer’s obligations during delivery:

The buyer must provide an accurate delivery address and correct contact information to ensure successful delivery. Upon receipt of the goods, the buyer is obliged to visually inspect the packaging. If any packaging damage is detected, the buyer has the right to refuse acceptance of the goods and must immediately inform the seller.

1.4. Delivery delays:

SIA Amber Cloud assumes no responsibility for delivery delays caused by the actions of the courier service provider or circumstances beyond the seller’s control. If delivery is delayed for more than 30 calendar days, the buyer has the right to unilaterally withdraw from the distance contract and request a refund for unfulfilled services or undelivered goods.

1.5. In case of unaccepted delivery:

If the goods are not accepted at the time of delivery due to the fault of the buyer (for example, incorrect address provided, no identification document presented, etc.), SIA Amber Cloud reserves the right to request compensation from the buyer for repeated delivery.

2. RETURN OF GOODS

2.1. Right of Withdrawal:

According to the Latvian Consumer Rights Protection Law and the EU Consumer Rights Directive, the buyer has the right to withdraw from the distance contract within 14 days from the date of receipt of the product without giving any reason. During this period, the buyer may exercise the right of withdrawal and return the product.

2.2. Product return conditions:

  • The product must be unused, complete, and in its original, undamaged packaging.
  • Paint cans and packaging must not be opened or damaged; otherwise, the product cannot be returned.
  • Before returning the product, the buyer must fill out the return form and obtain a product return number (PAN).

2.3. Return process:

Products may be returned using Omniva parcel terminals, Latvijas Pasts, or another courier service chosen by the buyer. Return costs are covered by the buyer, except in cases where the product is damaged or does not correspond to the order.

2.4. Refunds:

After receiving and inspecting the returned product, SIA Amber Cloud will refund the money within 14 days to the bank account specified by the buyer. The purchase price of the product and standard delivery costs will be refunded, deducting any additional costs for a more expensive delivery method chosen by the buyer, except in cases where the product was damaged or did not correspond to the order.

2.5. Exceptions to the right of withdrawal:

  • The right of withdrawal does not apply to goods made to the buyer's individual order or customized to the buyer's personal needs.
  • The right of withdrawal cannot be exercised if the product has been damaged due to improper use by the buyer or has lost its original appearance and quality.

2.6. Sample withdrawal form:

To exercise the right of withdrawal, you may use the sample withdrawal form provided below, but this is not mandatory. Alternatively, you may simply send your withdrawal notice by email info@ekokrasas.lv.

3. WARRANTY AND LIABILITY

3.1. Statutory warranty:

Consumers are entitled to a statutory 24-month warranty from the date of delivery of the product. The warranty does not cover damage resulting from improper storage or use of the paint, or if the original packaging has been opened and the defect has arisen for this reason. This provision does not limit the buyer’s rights regarding defects that already existed at the time of delivery.

3.2. Liability for damaged or non-conforming products:

If the buyer receives a product that is damaged, of poor quality, or does not correspond to the order, the buyer has the right to return the product or request its replacement with a new one.

3.3. Notification period for defects:

The buyer is obliged to inform the seller of defects within a reasonable period after their discovery by contacting customer service via email info@ekokrasas.lv or by calling +371 286 862 84.

3.4. Warranty service:

Complaints regarding product quality are reviewed in accordance with the consumer protection laws and regulations of Latvia. SIA Amber Cloud does not guarantee the suitability of products for specific buyer needs or particular uses unless clearly stated in the product description.

4. PERSONAL DATA PROTECTION AND PRIVACY

4.1.

The buyer’s personal data is processed in accordance with our privacy policy and cookie policy, available on the website www.ekokrasas.lvPersonal data obtained during the order and product return process is used solely for the purpose of facilitating these processes.

4.2.

Personal data may be transferred to third parties (for example, courier service providers) to ensure the delivery or return of goods.

5. DISPUTE RESOLUTION

5.1.

All disputes arising in connection with these delivery and product return terms shall be resolved through mutual negotiations. If no agreement is reached, the dispute shall be settled in accordance with the laws and regulations of the Republic of Latvia in the courts of the Republic of Latvia. In addition, consumers are subject to the laws of the country in which the consumer has permanent residence, to the extent that the mandatory consumer protection provisions of that country are applicable.
